TAXI1VILNIUS TERMS AND CONDITIONS OF SERVICE AND USE

1. General provisions

Taxi1Vilnius is a platform for the intermediation and organisation of passenger transport bookings that connects passengers with independent carriers engaged in passenger transport for remuneration on demand (hereinafter referred to as Carriers).

Taxi1Vilnius does not itself provide passenger transport services, is not the carrier for any specific journey and is not the employer of a Carrier. The function of Taxi1Vilnius is to accept and/or forward passenger bookings and to provide the technical and organisational means for a passenger and a Carrier to agree on a passenger transport service.

The specific passenger transport service is provided to the passenger by the Carrier who accepts the booking.

2. Status and obligations of Carriers

Carriers accepting bookings through the Taxi1Vilnius platform carry out passenger transport activities independently and at their own responsibility.

A Carrier must hold all permits, documents, insurance and other mandatory documentation required for its activities under the laws of the Republic of Lithuania and must ensure that the vehicle used complies with applicable legal requirements.

The Carrier is independently responsible for its actions, the vehicle and its technical condition, passenger safety, compliance with road traffic rules and other legal requirements, and the proper provision of the passenger transport service.

3. Booking and provision of the transport service

A booking submitted by a passenger through Taxi1Vilnius is forwarded to one or more Carriers.

Once a Carrier accepts the booking, the passenger transport service is provided by the Carrier who accepted that specific booking.

Taxi1Vilnius is not a party to the passenger transport transaction concluded between the passenger and the Carrier, except in respect of the booking intermediation and organisation service provided by Taxi1Vilnius.

4. Payment for the journey

The passenger pays for the passenger transport service directly to the Carrier who performed the specific journey.

Taxi1Vilnius does not receive or administer the passenger’s payment for a passenger transport service provided by a Carrier, unless clearly stated otherwise before the booking is placed.

Where an accounting document, invoice, receipt or another document prescribed by law must be issued for the transport service provided to the passenger, it is issued by the Carrier who provided the specific service.

Taxi1Vilnius receives remuneration from the Carrier for the booking forwarding, intermediation and/or organisation services provided by Taxi1Vilnius.

5. Carrier taxes and accounting

Each Carrier is independently responsible for accounting for its activities, recording and declaring income received from passengers, and calculating and paying all taxes, charges and other contributions applicable to it under the laws of the Republic of Lithuania.

Taxi1Vilnius is not responsible for the proper fulfilment of a Carrier’s individual tax, accounting or other obligations related to its independently conducted activities.

This provision does not release Taxi1Vilnius from obligations imposed directly on Taxi1Vilnius under the laws of the Republic of Lithuania in its capacity as a passenger transport organiser, platform operator or other entity, including, where applicable, obligations to collect and provide data to competent public authorities.

6. Liability for the journey

The Carrier who actually provides a specific passenger transport service is responsible for the provision and quality of that service.

The Carrier is liable, in accordance with applicable law, for damage caused to a passenger or third parties by the Carrier’s acts or omissions.

This may include traffic accidents, injury to a passenger, damage to or loss of the passenger’s property, improper passenger service and other acts or omissions directly related to the performance of a specific passenger transport service.

Taxi1Vilnius is not liable for the acts or omissions of a Carrier in cases and to the extent that, under applicable law, liability rests with the Carrier who provided the specific transport service.

Nothing in these Terms excludes or limits the liability of Taxi1Vilnius where such liability cannot be excluded or limited under mandatory provisions of the laws of the Republic of Lithuania.

7. Carrier documentation and right to carry out activities

The Carrier is responsible for maintaining a valid right to carry out passenger transport for remuneration on demand throughout the entire period in which bookings are performed.

The Carrier is also responsible for complying with all requirements relating to the permits, driver documentation, vehicle documentation, insurance and other matters required for its activities by law.

Taxi1Vilnius has the right to require the Carrier to provide documents confirming its right to carry out the activities and, where there are grounds to do so, to suspend or terminate the forwarding of bookings to the Carrier.

8. Passenger obligations

The passenger must provide accurate information required to fulfil the booking, comply with safe conduct requirements in the vehicle, refrain from damaging the Carrier’s property and follow lawful instructions given by the Carrier in relation to journey safety.

The passenger is liable, in accordance with applicable law, for damage caused by the passenger’s actions to the Carrier, the vehicle or third parties.

9. Complaints and disputes

Where a complaint relates to a specific journey, the Carrier’s conduct, the vehicle, journey price, payment, invoice or the quality of the passenger transport service, the Carrier who provided the specific transport service is primarily responsible for resolving that complaint.

Where Taxi1Vilnius has the necessary information and to the extent permitted by applicable law, Taxi1Vilnius may assist in identifying the specific booking and Carrier and may forward information or a complaint submitted by the passenger to the Carrier.

Disputes shall be resolved through negotiation. If no agreement can be reached, disputes shall be resolved in accordance with the procedure established by the laws of the Republic of Lithuania.

10. Personal data

Taxi1Vilnius processes the personal data of passengers and Carriers only to the extent necessary to accept, forward and administer bookings, provide customer service, comply with legal obligations and pursue other lawful purposes.

More detailed information about the processing of personal data is provided in the Taxi1Vilnius Privacy Policy.

11. Application of the Terms

By using Taxi1Vilnius services and submitting a passenger transport booking, the passenger confirms that they have had the opportunity to review these Terms and agrees that the booking may be forwarded to an independently operating Carrier.

These Terms shall be interpreted and applied in accordance with the laws of the Republic of Lithuania.

If any provision of these Terms conflicts with mandatory provisions of applicable law, the relevant legal provisions shall apply and the remaining provisions of these Terms shall remain in force.
